The man accused of raping a 19-year-old mentally disabled man in a Miller Park bathroom in Gilroy is scheduled to appear in court Oct. 16 to possibly settle his case.
Gyasi Terran, 24, last appeared Aug. 26 in front of Santa Clara County Superior Court Judge Teresa Guerrero-Daley.
The judge, at the request of Terran's public defender, scheduled a "felony advanced resolution" hearing at the San Martin Courthouse.
The hearings allow both sides to settle a case rather than go to the preliminary hearing stage, when the prosecution must lay out enough evidence for a trial to begin.
Terran was arrested on suspicion of raping the teen in the early morning hours of June 4.
An awkward sexual encounter ensued between the two, beginning with the promise of a cigarette, according to police interviews and reports.
Terran told police the encounter was consensual, according to an interview transcript in the court file.
